Plain-language summary: We build fences and decks across Saskatchewan. When you accept a written quote from us, these Terms — together with that quote — form the agreement between us. They cover what we will do, when we'll do it, how payment works, how we handle weather and changes, and our workmanship warranty.
1. Agreement & Acceptance
These Terms of Service (the "Terms") form a legally binding agreement between you (the "Client", "you", "your") and Praetoria Fencing & Decking, a division of Praetoria Group operating in Regina, Saskatchewan ("Praetoria", "we", "us", "our").
By signing or otherwise accepting a written quote, paying a deposit, or allowing us to begin work, you confirm that you have read, understood and agreed to these Terms together with the scope, pricing and timelines described in your quote (together, the "Agreement"). If anything in your signed quote conflicts with these Terms, the signed quote controls.
2. Definitions
- "Project" — the fence, deck, gate, pergola, repair or related work described in your written quote.
- "Site" — the property address where the Project will be installed.
- "Materials" — all wood, composite, vinyl, metal, fasteners, concrete and hardware supplied for the Project.
- "Deposit" — the upfront payment that secures your build slot and orders Materials.
3. Scope of Services
Praetoria provides design, supply, installation, repair and staining services for residential and commercial fences and decks, including but not limited to: wood, vinyl, chain-link, ornamental and composite fencing; pressure-treated and composite decks; pergolas; gates and gate hardware; post replacement and general repairs.
The exact scope for your Project is the scope written in your quote. Anything not listed in the quote is not included unless added by a written change order (see Section 10).
4. Estimates & Quotes
- Quotes are valid for 30 days from the date issued unless otherwise stated.
- Quotes are based on the information provided to us, a visual inspection of the Site and current Material pricing. We reserve the right to revise pricing if Site conditions, scope or Material costs change materially before work begins.
- Verbal estimates are for discussion only and are not binding until issued in writing.
5. Deposits & Payment
Unless your quote states otherwise:
- A non-refundable deposit (typically 25–50% of the contract price) is required to lock your build slot, order Materials and schedule crews.
- On larger projects, progress payments may be invoiced at defined milestones (e.g. material delivery, framing complete).
- The final balance is due upon substantial completion of the Project, before any minor deficiency items are scheduled.
- We accept e-Transfer, major credit cards, debit and cheque. Credit-card payments may include a processing surcharge if disclosed in your quote.
- Overdue invoices accrue interest at 1.5% per month (19.56% per year) from the invoice due date until paid in full. You are responsible for any reasonable collection and legal costs incurred to recover unpaid amounts.
6. Scheduling & Weather
Start dates are estimates based on crew availability, Material lead times and weather. Saskatchewan weather can change rapidly; for the safety of our crew and the quality of your build we may pause work during heavy rain, high winds, lightning, extreme cold or frozen ground conditions.
Weather-related rescheduling is not a breach of this Agreement and does not entitle either party to a price adjustment. We will provide reasonable notice and a new target window as soon as the forecast allows.
7. Site Access & Preparation
You agree to:
- Provide safe, unobstructed access to the work area, including moving vehicles, garbage bins, planters, patio furniture and children's play structures before our crew arrives.
- Keep pets indoors or restrained while crews and equipment are on Site.
- Remove existing fencing, landscaping or obstructions only if your quote does not include demolition.
- Confirm property lines. We install along the lines you direct us to. We are not responsible for boundary disputes between you and your neighbours.
- Provide reasonable access to water and a standard 120V outlet where required.
8. Permits, Locates & By-laws
We will arrange a free Sask 1st Call utility locate before any digging begins for public utilities (gas, power, telecom, water). You are responsible for marking or disclosing private buried items, including but not limited to: irrigation lines, low-voltage lighting, dog-fence wires, invisible fencing, septic lines, gas lines to outbuildings, hot tubs and pool equipment. We are not liable for damage to unmarked private utilities.
Where a municipal permit, development permit or HOA approval is required, you are responsible for obtaining it unless your quote explicitly includes permit handling. You confirm that your Project complies with all applicable local by-laws, easements and restrictive covenants.
9. Materials & Substitutions
Natural wood products will exhibit normal characteristics including knots, grain variation, checking, cupping, twisting and colour change as they weather. These are not defects.
If a specified Material becomes unavailable or substantially delayed, we may substitute a comparable product of equal or greater quality. Where the substitution materially changes appearance or price, we will obtain your written approval first.
10. Change Orders
Any change to scope, materials, layout or finish after work begins must be documented in a written change order and signed (electronically or on paper) by both parties. Change orders may affect price and schedule. Verbal change requests are not binding until confirmed in writing.
11. Workmanship Warranty
We warrant our installation workmanship for two (2) years from the date of substantial completion against defects caused by faulty installation. Material defects are covered by the manufacturer's warranty, which we will help you claim.
This warranty does not cover:
- Normal weathering, fading, checking, cupping, knots or movement in natural wood.
- Damage caused by storms, hail, wind, flooding, frost heave, ice build-up, fire, vandalism, vehicle impact, settling soil or other acts of God.
- Damage from third-party work (e.g. landscapers, snow removal, pressure washing) performed after our installation.
- Failure to perform recommended owner maintenance (sealing, staining, hardware tightening).
- Repairs performed by anyone other than Praetoria without our prior written approval.
Warranty claims must be submitted in writing to fencinganddecking@praetoriagroup.ca. The warranty is non-transferable and applies only to the original Client at the original Site address.
12. Limitation of Liability
To the maximum extent permitted by law, our total liability under this Agreement — whether in contract, tort, warranty or otherwise — is limited to the amount paid by you for the Project. We are not liable for indirect, incidental, special or consequential damages including lost use, lost rental income or emotional distress.
Praetoria carries general liability insurance and WCB (Workers' Compensation Board) coverage. Proof of coverage is available on request.
13. Cancellations & Refunds
You may cancel this Agreement within 10 days of signing for a full refund of any deposit paid, provided that Materials have not yet been ordered or cut to size and crews have not been mobilized.
After 10 days, or once Materials are ordered or work has begun, the deposit is non-refundable to the extent of Materials, custom cuts, restocking fees and crew time already incurred. Cancellation within 48 hours of a scheduled start date may incur a mobilization fee of up to $500.
We may suspend or cancel work if payment is more than 14 days overdue, if Site conditions are unsafe, or if you materially breach this Agreement. In that case you remain responsible for work completed and Materials supplied to that point.
14. Disputes & Governing Law
This Agreement is governed by the laws of the Province of Saskatchewan and the federal laws of Canada applicable in it. The parties attorn to the exclusive jurisdiction of the courts located in Regina, Saskatchewan.
Before commencing any legal proceeding, the parties agree to attempt in good faith to resolve the dispute through direct discussion and, if necessary, non-binding mediation in Regina.
15. Privacy & Communications
Personal information you provide to us is handled in accordance with our Privacy Policy. By providing your phone number and email, you consent to receive transactional messages about your quote, schedule, invoices and warranty. You can opt out of marketing communications at any time.
We may photograph completed work for marketing and portfolio use. Photos do not include identifying information about you or your address. Let us know in writing if you prefer we not photograph your Project.
